Fix probation flaws by returning services to public ownership, says UNISON

Commenting on the National Audit Office’s Transforming Rehabilitation: Progress Review published today (Friday), UNISON national officer Ben Priestley said: “This is a devastating critique of a catastrophic privatisation and reads like a catalogue of disaster.

“Rather than ploughing on regardless with a failed system, the Justice Secretary must now take control and bring these contracts back into public ownership.

“No amount of tinkering around the edges will make these CRCs work. The probation service needs to be unified, for the sake of community safety, the public and staff.”

New proposals could help protect the NHS from an uncertain world post-Brexit, says UNISON

Commenting on proposals published today (Thursday) by NHS England setting out possible reforms to remove competition and reduce privatisation in the health service, UNISON head of health Sara Gorton said:

“The government introduced the despised Health and Social Care Act against the advice of those who knew the NHS best. The market-driven system ushered in by the Act has already cost the NHS dearly.

“Resources that could have been spent caring for patients have been diverted into bidding for contracts – often against other parts of the NHS. Over-complex processes have been an unwelcome distraction for staff too.

“Ministers must not miss this opportunity to correct the worst aspects of that legislation.

“As the UK heads into an uncertain post-Brexit world, the NHS must be protected from the scourge of unnecessary competition and predatory private firms taking advantage of a possible weakening of UK trade rules.”

UNISON launches campaign to combat musculoskeletal injuries

Today is national RSI – or repetitive strain injury – awareness day and UNISON is taking the opportunity to launch a campaign for better management of all musculoskeletal injuries. 

The union has conducted research into a random sample of 50 claims made by UNISON members that have occurred because of musculoskeletal injuries.

We found that 90% of such claims were caused by basic failings in risk assessments, while 21% of the claims were caused by staffing difficulties, with staff often being forced, to single-handedly manually lift loads that required two people or more to do it.

And one of the most common reasons regulatory bodies have to take enforcement action against employers is when equipment such as slings or hoists is poorly fitted or maintained.

UNISON’s acting national head of health and safety Robert Baughan said: “This shows employers too frequently failing to carry out their basic health and safety duties.

“It also shows the damage this government’s austerity agenda – and the resulting staffing cuts – is doing to our members’ health and safety.”

Members and reps can help to reduce injuries by:

  • becoming or recruiting safety reps – the more safety reps we have, the more effectively we can hold employers to account’
  • complying with any health and safety guidance and instructions from employers;

Health and safety reps should be calling on employers to:

  • carry out robust risk assessments;
  • where possible, eliminate the need for manual handling by providing mechanical aides;
  • where this is not possible, reduce the risk by minimising manual handling or ensuring there are sufficient staff to safety manage difficult or heavy loads;
  • providing suitable, appropriate and well-maintained equipment, such as adjustable visual display units and chairs, and well-maintained and appropriate lifting aides such as slings and hoists.

Public service workers deserve better than poverty wages, says UNISON

Commenting on new data published today (Thursday) by the Living Wage Foundation that shows over one million public sector workers are earning less than the real living wage, UNISON assistant general secretary Christina McAnea said:

“Hundreds of thousands of workers delivering essential public services are on poverty pay. Many have second and even third jobs just to keep the wolf from the door. This is taking a toll on their health, family life and productivity too.

“Last year’s NHS and council pay deals saw the lowest-paid workers’ wages go above the real living wage. But colleagues on outsourced contracts in care, cleaning and catering weren’t so fortunate and many are still on the legal minimum.

“In a decent, caring society no-one should be struggling like this. Dedicated public servants deserve better.”

– The real living wage is independently calculated and is based on the real cost of living. It is currently £9 an hour across the UK and £10.55 in London.
– On Monday more than 40 cleaners, catering staff, porters and security officers employed by the private company OCS at Liverpool Women’s Hospital went on strike over the company’s refusal to pay them the NHS rate for the job. The lowest pay rate for a worker in the NHS is £8.93 per hour, but the OCS staff get considerably less, with some only receiving the minimum legal hourly rate of £7.83. More strike dates are planned.
– Stephanie Mahoney works as a domestic at Liverpool Women’s Hospital. She is paid £7.83 an hour, and says: “It’s a real struggle to cope on the wage I’m on. I’m a single parent and need to keep a roof over my son’s head. Gas and food bills keep going up for everyone so it’s harder for us to make ends meet. I sometimes work alongside colleagues paid £9 an hour, but we’re doing the same work.”

Dave Prentis urges MPs to extend Article 50 notice period

“Leaving the EU without a deal would be a catastrophe for public services and all those who work in them,” Dave Prentis declared in an email to Labour MPs today.

Writing ahead of today’s parliamentary votes on Brexit motions and amendments – plus the votes in March announced by the prime minister yesterday – the UNISON general secretary also reaffirmed that the union “cannot accept any undermining of the Belfast Agreement or peace in Northern Ireland”.

He urged MPs to back moves to extend the Article 50 withdrawal process “not to stop Brexit, and not to overturn the referendum – but to provide Parliament with an opportunity to seek the best possible deal for our country”.

MPs are discussing and voting on a number of Brexit motions and amendments today. Prime minister Theresa May has promised a “meaningful vote” on the withdrawal agreement – agreed in principle between the UK and EU, but overwhelmingly rejected by MPs in January – following further discussions between the government and EU on 12 March.

If it is rejected again, MPs have been promised a vote on whether they would accept a no-deal Brexit on 13 March. If that is rejected, they will be asked to vote on seeking an extension of the Article 50 period on 14 March.

Britain’s current two-year notice of leaving the EU under Article 50 means the country would cease to be a member on 29 March.
The full text of Mr Prentis’s email to Labour MPs reads:

Throughout this period of Brexit uncertainty, UNISON’s position has been clear – leaving the EU without a deal would be a catastrophe for public services and all those who work in them.

And we cannot accept any undermining of the Belfast Agreement, or peace in Northern Ireland. Both no deal Brexit and a hard Brexit fail these simple but crucial tests.

Of course, things are fast moving, but we remain consistent in our call for an extension to Article 50 – not to stop Brexit, and not to overturn the referendum – but to provide Parliament with an opportunity to seek the best possible deal for our country.

With only 32 days remaining until we exit the EU, there is a backlog of Brexit bills and Statutory Instruments to be debated and scrutinised – simply put, Parliament needs more time to avoid chaos, even in the event that a deal can be reached quickly.

On behalf of 1.3 million public service workers in your community and across the UK, I am asking you to vote to extend Article 50 and give public services a chance to avoid disaster.

Tell David Gauke to make probation public again

UNISON is backing a call for probation services in England and Wales to be brought back into public ownership.

The launch of a petition by campaign group We Own It comes days after a joint letter to justice secretary David Gauke on the issue from UNISON, GMB and probation officers’ union NAPO.

That, in turn, followed the collapse of one of the ‘community rehabilitation companies’ which have took over probation services for ‘non-serious’ offenders under former justice secretary Chris Grayling’s privatisation in 2015.

The company Working Links, went into administration in early February. It operated contracts covering probation in Wales, Avon and Somerset, and Devon and Cornwall. Those contracts and staff have now been transferred to another private company.

UNISON is urging its members, and the public, to sign the We Own It petition calling for the government to bring the service back in-house when all the current community rehabilitation contracts end in 2020 – two years earlier than planned because of the problems encountered in the privatised service.

We Own It points out that since the government put 70% of England and Wales’ probation into private hands:

  • the new community rehabilitation companies are failing to meet two thirds of their targets;
  • ex-offenders are finding it harder to reintegrate back into society, and more of them are reoffending;
  • the number of people committing a serious further offence while under probation supervision has risen 20%.

Police staff now less representative of communities, says UNISON

The proportion of police staff from Black, Asian and minority ethnic backgrounds (BME) employed by police forces in England and Wales has fallen dramatically, says UNISON research published today (Wednesday).

There has been a drop of nearly a third in the proportion of BME police community support officers (PCSOs), according to an analysis of Home Office data*. They represented just 9.5% of the total PCSO workforce in 2018, compared with 14% in 2005.

The trend is also downwards for BME support staff such as front desk enquiry officers and 999 call handlers. The proportion fell from 7% to 6.8% over the same timescale.

BME police officer representation has risen slowly from 3.5% in 2005 to 6.6% in 2018, but UNISON says this increase is not nearly enough.

The UNISON findings are published 20 years on from the Macpherson report which called for radical improvements in policing towards race and diversity.

UNISON says the figures highlight how police forces are failing to represent the communities they serve, and that cutbacks are partly to blame for the drop in BME police staff and PCSOs.

The union is calling on the Home Office and police forces to come up with an action plan to reverse what it says is a worrying trend.

A joint pledge to improve race equality in the police service has also been agreed between UNISON and the National Black Police Association (NBPA).

Both organisations plan to raise their concerns with the home affairs select committee over the lack of progress in BME representation in the police service since Macpherson.

UNISON national officer for police and justice Ben Priestley said: “This fall is deeply concerning and damages the credibility of the police service.

“Policing should be coming more – not less – representative of the communities it serves. Police staff have a hugely important role assisting not only police officers but the public too.

“The danger is that progress made by the police service in diversity since the Macpherson report will be jeopardised unless this decline is reversed.”

NBPA vice president Franstine Jones said: “Police staff perform many important roles. But their decline has gone unnoticed because the focus has always been on police officers.

“The NBPA will be working with UNISON to highlight the real picture of BME staffing.”

Commenting on the annual NHS staff survey out today (Tuesday), UNISON head of health Sara Gorton said:

“While the government is consumed with Brexit, ministers are paying scant attention to growing problems in our public services. With so few staff, it’s no wonder the pressures of working in the NHS are making so many health workers ill.

“The combination of rising stress levels along with bullying and bad behaviour from managers and colleagues shows the pressure is really getting to staff. It’s a testament to them that they keep going, but the government can’t expect this to continue.

“With the risk of abuse or violent attack from patients or the public ever present – especially in the ambulance service, some NHS workers understandably want out. Ministers must get to grip with the pressing issue of chronic understaffing. or the health service’s problems will go from bad to worse.”

Blog: Northern Ireland must come first, no matter what else is in the Brexit deal

In a matter of weeks, the United Kingdom’s relationship with the European Union is set to change. For Unison, the impact this will have on Northern Ireland has always been paramount.

Yet too many people – including politicians who should know better – continue to reduce the impact Brexit will have on Northern Ireland to a conversation only about the movement of goods across the border. The reality is far more grave and complex. Brexit is an issue that seriously affects the peace process and will interfere in the day-to-day lives of ordinary people, North and South.

Unison has always offered unwavering support for the peace process, campaigning for the Good Friday Agreement and leading calls for genuine power-sharing government ever since. Yet as things stand, that international agreement – of which the British government is a guarantor – is under threat. Brexit has already been a significant factor in the collapse of Stormont and the failure to get it back up and running again. This has had a huge impact on Northern Ireland as a whole, and public services in particular.

At the same time, equality of citizenship – a right to choose British, Irish or both forms of citizenship on an equal basis, guaranteed by the Good Friday Agreement – is also threatened by Brexit. Parity of esteem, or equal treatment was promised irrespective of the identity chosen. Yet a no-deal Brexit risks immediately creating borders between different forms of citizenship that the Good Friday Agreement was meant to pull down. Both the British and Irish governments need to move to resolve these issues speedily, including through a new bilateral treaty on the Common Travel Area. This clarifies people’s rights and ensures it is not just ‘written in sand’ as the Human Rights Commissions in both jurisdictions on the island of Ireland fear.

These are huge and real concerns that go beyond the need to avoid a hard border. Yet they are not insurmountable.

As I’ve said repeatedly, Unison does not support Theresa May’s deal, but has always recognised that any agreement between the EU and the UK will not be possible unless there is a backstop. Our members in Northern Ireland need this insurance policy, which is designed to both keep an open border across the island of Ireland and mitigate the impact of Brexit on the Good Friday Agreement and the peace process.

We have no problem with a backstop. But we do have problems with plans to water down or eliminate it. By attempting to change the backstop, the Prime Minister risks weakening it and removing vital protection for the people of Northern Ireland. Simply put, an insurance policy is no good if it provides no cover when things go wrong.

Some of the opposition to the backstop has centered around the idea that it will create a border in the Irish Sea and challenge the current status of Northern Ireland as part of the United Kingdom. Unison does not want to see any border in the Irish Sea and we support the principle within the Good Friday Agreement that the future status of Northern Ireland is for its people to decide. The backstop clearly states it does not interfere with this principle.

What is needed then is not only a backstop but a future relationship with the EU that builds upon and strengthens the protection set out within it. One which also protects the Good Friday Agreement in all its parts. That’s something that’s good for Northern Ireland, and England, Scotland and Wales too.

As we move towards 29 March and the prospect of a ‘no deal’ becomes even starker, we need to recognise that a ‘no deal’ means no backstop and a hard border. The impact that will have on the island of Ireland cannot be underestimated. It would be a stark reminder of the dark days of conflict. It would inevitably create a target for those opposed to the peace process. It would divide communities. It would hit the 20,000 people who cross the border every day for work and study – including many public service workers who belong to Unison

The peace process was about removing the borders between people on the island of Ireland. Brexit risks putting them back up.

There has to be another way. Peace has been too hard won to be throw away so cheaply. To protect Northern Ireland and the Good Friday Agreement, a ‘no-deal’ Brexit must be avoided at all costs. A backstop is essential – not as a temporary measure, but as a bridge to a future relationship with Europe. Only by taking that approach can we avoid borders and violence whilst securing citizenship rights, jobs, communities and peace.

The impact of Brexit on Northern Ireland cannot be reduced to simplistic quotes about borders or considered only as an afterthought. For Unison – and for Parliament – it must be integral.

Government must end private contracts before it’s too late, say probation unions

Unions have urged the Justice Secretary to end the failed system of privatised probation contracts and bring them back into public ownership before there is ‘drastic and irreversible damage’ to the service.

In a joint letter to David Gauke, the three unions representing staff in the probation service – UNISON, Napo and GMB – said the community rehabilitation company (CRC) contracts must be abandoned when they end next year.

Earlier this month three of these contracts collapsed when the company operating them – Working Links – went into administration. The contracts and staff have been transferred to another operator Seetec.

In their letter the unions say that the government ‘lost control’ of the services in Wales, Avon and Somerset, and Devon and Cornwall. They highlight that the government failed to keep promises and assurances made prior to privatisation that if problems occurred with contracts they would be brought back under public control.

Ministers should have stepped in when it was clear the company was in trouble, say the three unions.

The letter says during the tendering process “probation unions were reassured that the Ministry of Justice had appropriate contingency plans in place to step in if private contractors failed to provide services or hit key targets”.

The letter then asks why “the remedial action plans, designed to cope with a collapse scenario such as the one which recently unfolded, were not put into operation in the South West and Wales”.

The unions continue: “Despite the failings of Working Links being well-trailed, your department has failed to step in and take control.”

A series of 21 CRCs was created in 2014 and the contracts for their management began the following year. These will finish in December 2020 to be replaced by 10 larger contracts.

But Napo, UNISON and GMB said these plans should be dropped and all the contracts brought back into public ownership “before drastic and irreversible damage is done to the probation service”.

Collapse of Working Links contracts

We are writing to raise our concerns over the government’s handling of the collapse of the Working Links community rehabilitation company (CRC) contracts last week and in particular the circumstances that led to your department allowing Working Links to file for insolvency rather than stepping in at a much earlier point to bring the obviously failing contracts back under public control. Dame Glenys Stacey’s HMIP report on Working Links, published last week, makes clear just how far the performance of the company had fallen.

During the tendering of the CRC contracts in 2013/14, probation unions were reassured that the Ministry of Justice had appropriate contingency plans in place to step in if private contractors failed to provide services or hit key targets. The government retained a so-called ‘golden share’ in each CRC to ensure this was possible.

Why then were the remedial action plans, designed to cope with a collapse scenario such as the one which recently unfolded, not put into operation in the South West and Wales?

Your predecessor reassured us that persistent breaches by a CRC contractor would lead to termination of its contract and, that if a CRC failed under private ownership, it could simply be brought back into public ownership without the complexity of staff transfers. But, despite the failings of Working Links being well-trailed, your department has failed to step in and take control.

Can you advise why there was no apparent attempt by MoJ at intervention prior to the contracts going into administration and why, in particular, the Working Links contracts were not terminated prior to their collapse?

By allowing Working Links to declare insolvency, the government lost control of the delivery of probation services in Wales and the South West. We consider this has further damaged the credibility of the Ministry of Justice and has done nothing to reassure the public, service users or staff over the proposals outlined in ‘Strengthening Probation, Building Confidence’.

We urge you again to rethink your proposals in ‘Strengthening Probation, Building Confidence’ and to take the opportunity to bring all the CRCs back into public ownership in December 2020.

This would allow for a period of reflection before drastic and irreversible damage is done to the probation service. We are sure you agree that the current timetable to re-let the CRC contracts in December 2020 is not credible, hence the contingency plans being made to extend the existing CRC contracts, presumably at further great cost.

The unions are keen to work with you and your officials to re-set a positive direction for probation, but this will need all of the above to be taken into account.

Cleaners and caterers strike for fair pay at Liverpool Hospital

Catering staff, cleaners and security guards are among UNISON members striking at Liverpool Women’s Hospital today over their private employer’s refusal to pay them the NHS rates for their jobs.

More than 40 union members are employed by OCS, which supplies contracted out ‘soft facilities’ at the hospital, and delivered a 100% vote in favour of strike action in a formal ballot.

The lowest pay rate for a worker in the NHS is £8.93 per hour, but the OCS staff are paid considerably less than this with some only receiving the minimum legal hourly wage rate of £7.83.  Staff are losing out by up to £2,150 this year alone.

Other staff doing the same jobs at Liverpool Women’s Hospital and at other hospitals are being paid the correct nationally agreed pay rates for NHS workers.

A strike over a similar issue was averted at the nearby Walton Centre.

More than 80 staff employed by the company ISS voted to take strike action, but the Walton Centre Trust stepped in to commit to staff that they will receive the NHS rates of pay.

Stephanie Mahoney works as a domestic at Liverpool Women’s Hospital and is paid the minimum wage of £7.83 an hour.

“It’s a real struggle to cope on the wage that I’m on,” she says. “I’m a single parent and I need to keep a roof over my son’s head. Gas and food bills keep going up for everyone but it’s harder for us to make ends meet.

“I sometimes work alongside colleagues who are paid £9 an hour, but we’re doing the same work.

“Colleagues are very supportive of us taking action to get this sorted out because they don’t think it’s right that we’re on lower pay than them.

“I’ve never been on strike before but I can’t see how else this is ever going to change. We’re all sticking together.”
