UNISON wins legal pay out for 5,000 low-paid women in schools and nurseries in Greenwich

Five thousand part-time cleaners, teaching assistants, catering, administrative, school meal workers and other staff working for Greenwich Council are to receive pay outs that could amount to hundreds of pounds, following a five year legal battle over holiday pay, says UNISON today (Wednesday).

UNISON took the case on behalf of the Royal Boroughs employees the overwhelming majority of whom are women over the councils failure to calculate their annual leave properly. As a result some of the staff had been losing up to five days pay a year.

Using European law, UNISON brought employment tribunal claims on behalf of 476 of the term-time only staff, arguing that they had been unlawfully treated less favourably than colleagues owing to their part-time status.

The settlement,worth approximately 4m, was approved at a full council meeting this evening. Councillors agreed to revise the formula used to calculate the holiday allowance and pay the correct rate, backdated to 1 January 2013.

The problem was first identified in 2012, when Julie, a school cleaner who has lived and worked in the borough all her life, noticed shed lost a significant amount of pay when her contract changed from a full year to a term-time only one.

Commenting on the case, UNISON assistant general secretary Christina McAnea said: This is a victory for all low-paid women working in the public sector. What started out as just one case could soon be having an impact far beyond South East London.

Laws that began life in Europe have enabled UNISON to restore justice and ensure that all part-time workers in the Royal Borough of Greenwich are paid the correct holiday pay for the jobs they do.

Other employers may have made similar errors with their holiday calculations. If they have, well be on to them to make sure all term-time staff are paid what theyre due.

While the case brought by UNISON only involved 476 workers, the corrected formula and back pay will apply to all 5,000 term-time only staff employed by the council. UNISON understands the settlement will be paid before the end of the year.

The part-time workers involved in this case are employed on term-time only contracts in schools and nurseries across Greenwich. They mainly work as teaching assistants, and in early years, catering, as family support advisors, family liaison officers, school meal supervisors, home school liaison, data administration, school admission officers and as learning mentors.

New strategy to tackle violence in the NHS welcome, says UNISON

Commenting on the government’s NHS violence reduction strategy announced today (Wednesday), UNISON head of health Sara Gorton said:

“NHS staff spend their working days caring and saving lives, and their safety should be paramount.

“No-one should be abused, threatened or attacked at work – especially when all they’re trying to do is help people.

“It’s encouraging that the government has listened to unions and agreed to review measures in place to ensure staff safety.

“This includes a more joined up approach between the NHS, police and the Crown Prosecution Service. Anyone who threatens or abuses NHS staff should be prosecuted under the new law protecting health care workers.”

‘Empty nest’ couples and people without children robbed of benefit boost, says UNISON

Low-paid working couples who receive benefits and whose children have left home will be denied a pay boost by the Chancellor, UNISON said today (Wednesday).

Childless people on universal credit will be losers too despite the increase announced in yesterday’s Budget to the work allowance – the monthly amount employees can keep before their benefits are affected.

Only those with disabilities, or parents with current responsibilities for children, will be eligible for the work allowance rise, in a move described by UNISON as ‘underhand’.

Around two thirds of current universal credit claimants needing support with housing costs will be affected*, according to UNISON. It means they will hardly gain at all from the national minimum wage rise, which is to go up from £7.83 an hour to £8.21 next April.

Instead, nearly their entire annual pay rise – now worth more than £3,000 a year – will go straight into Treasury coffers. A tiny proportion – less than 10% – of this hard-earned money will end up in their pay packets despite rising rents, says UNISON.

UNISON general secretary Dave Prentis said: “Philip Hammond hasn’t gone far enough. He needs to help people and couples without children too and those whose families have left home.

“If the Chancellor wants to support the poorest, he needs to increase work allowances for everyone.”

-*This is based on June 2018 calculations.
-The work allowance for working couples on universal credit with grown up children and childless people was £111 a month. However, it was cut to zero in April 2016 and has not been increased in the Budget.
-People without children and couples whose children have left home, who need help with housing costs, will see their annual pay rise from £11,830 a year (April 2015) to £14,942 a year (April 2019). But they will only keep £305.68 of this rise based on one earner on the national minimum wage working 35 hours a week.
-The latest figures show than 1.2 million people are now on universal credit. That figure is expected to rise 3 million by the end of 2019. It will eventually reach between 7 and 8 million when it is fully rolled out.
-Former chancellor George Osborne reduced work allowances in the July 2015 Budget for those on universal credit.
-Universal credit payments go down at a current rate of 63p for every £1 of earnings.
-The impact ofa zero increase in the work allowance on the pay of someone on the minimum wage getting a £100 a month rise would be a £20 rise in tax, a £12 increase in national insurance, and a £42.84 cut in universal credit. They would receive just £25.16 of their £100 a month increase, with the rest going back to the Treasury, according to UNISON calculations.

UNISON responds to funding for crisis mental health services

Responding to today’s (Monday) announcement by the Chancellor of £2bn for mental health services, UNISON head of health Sara Gorton said:

“Promising more funding is one thing – actually delivering is another.

“There’s no doubt more money is needed. But the government must listen to those quitting mental health jobs every day and do more to attract and hold onto highly skilled staff.

“More must be done to make mental health services safer and kinder places to work – for the benefit of patients and staff.

“But what we spend on the NHS in general is a fraction of what other countries pay out for healthcare.

“The amount announced today is likely to be swallowed by deficits, which effectively means standstill funding at a time when all of us need the NHS more.”

Blog: What this budget proved is that austerity is far from over

Over the past decade, austerity has caused untold damage to our communities and our public services. Our union has fought austerity every step of the way, using every weapon at our disposal.

We’ve now won the public debate on austerity – it’s widely recognised as a disaster. Even the Prime Minister was keen to announce that it’s over.

Yet what this budget proved is that austerity is far from over. The Chancellor claimed it’s “coming to an end” – but even that isn’t true.

Years of spending cuts have meant real pain for millions, with very little gain. Public services are running on empty, and councils are still axing thousands of jobs.

Years of wrecking ball austerity have left local services in a perilous state. It will take time and substantial investment for them to recover.

Instead, this was a budget that didn’t deliver the meaningful increases across public services that would mean a real end to austerity.

This was a budget that provided no new money for local government after a decade of vicious cuts (except a measly sum for social care that won’t come close to ending the care crisis).

This was a budget where the much heralded increases to NHS funding will barely cover projected deficits (if that), and the “extra” funding for mental health is coming from previously announced NHS funds, and only covers acute mental health services, not much needed prevention.

This was a budget which claimed to end PFI – something which our union has campaigned for – but which in reality does nothing to end the scandal of existing PFI, save for a “centre of excellence”, a contradiction in terms when it comes to PFI surely.

This a budget that allocated more new money to potholes than to schools at breaking point.

This was a budget that failed to deliver the real change our country needs, especially at a time of Brexit uncertainty. However one of the few rays of light to come out of the budget was that the government has partly listened to UNISON’s campaigning on the universal credit work allowance.

We called for an increase, and the government has promised to assist some people – but still left single people and couples without children without help. Unsurprisingly, ministers remain wedded to the rest of universal credit, despite all its flaws.

Our country deserves better than this. After eight years of letting down public services and our communities, we need a radical Labour government committed to fundamental change in our economy and our society. The Tories, as this budget showed, are capable of nothing more than meddling at the margins.

PFI abolition pledge doesn’t help public services with contracts

Commenting on the Chancellor’s pledge that the government is to abolish the use of new private finance contracts (PFI), UNISON general secretary Dave Prentis said:

“Public services can’t be financed on the never-never, and the Chancellor’s promise that there’ll be no more PFI contracts signed is welcome.

“But this does nothing to help the many hospitals, councils, police forces and schools. They’ll be paying through the nose for many years to come for what are now brand new buildings, but which won’t be when the debts are finally paid off.

“Expensive interest payments are eating away at already under pressure budgets, hitting care for patients and learning in the classroom. This is money wasted that could have been used for beleaguered public services.”

Commenting on the Chancellor’s Budget statement today (Monday), UNISON general secretary Dave Prentis said:

“Austerity isn’t over just because the Prime Minister and the Chancellor say it is.

“Years of spending cuts have meant real pain for millions, with very little gain. Public services are running on empty, and councils are still axing thousands of jobs.

“Years of wrecking ball austerity have left local services in a perilous state. It will take time and substantial investment for them to recover.

“Councils need an end to this nightmare created on Downing Street. An extra bit of money for social care is just the start. Much more is needed and quickly if we are to hold onto the very fabric of our communities.”

Higher education ballot result

UNISON members working in higher education in England, Scotland and Wales have voted for industrial action to press their wage claim – but the turnout wasn’t enough to meet the threshold for strikes set out in the 2017 Trade Union Act.

That act does not apply in Northern Ireland, and the union is still awaiting the result of its ballot of members there.

UNISON’s higher education service group executive considered the result in England, Scotland and wales and stated: “We would like to thank those activists, branches and regions that put in significant work to achieve the result.

“Unfortunately and frustratingly the government’s anti-democratic trade union laws, which impose a very high turnout threshold, mean that we are not able to fulfil our members’ wishes.”

It also warned that “this outcome will only further fuel the anger of our members who face yet another year of a below inflation pay rise. No university should be pay any staff less than the living wage and employers should be ashamed that some of their staff are forced to go to food banks.”

UNISON’s higher education branch seminar next week will review the pay campaign, “take heart at the positives and build for the next pay negotiations,” the executive noted.

“This result will inform our approach to next year’s pay negotiations and the employers should be in no doubt that we will again call for action if the HE employers do not meet our aspirations for a fair above inflation pay offer.”

Conference debates access to voting, hate crime and BSL

A busy morning at UNISON’s disabled members’ conference continued with a debate on access to voting.

Alvin Chambers of Newcastle City told delegates that “all voters have the right to vote independently and in secret … I know this, because the Electoral Commission says so on the website”.

But as he went on to explain: “Good luck getting into the voting station if you’re in a wheelchair and, if you do get in, the polling booth probably won’t be accessible to you.

“What if you’re blind and there’s no braille ballot paper?” In that case, the clerk at the polling station will probably read you a list of candidates and then put a cross where you tell them. As Mr Chambers noted, the cross will almost certainly be put against the name you say, “but it’s hardly secret”.

Iain Scott-Burdon, on behalf of the deaf caucus, pointed out the problems that deaf voters face to voting – “for instance, hustings … are interpreters provided? They’re not”.

And if a candidate knocks on your door, Mr Scott-Burdon said that he wouldn’t be able to have a conversation. “It’s time for access for everybody.”

Delegates also raised concerns about the trials, earlier this year, of photo ID being required in order to vote.

In an impassioned debate on recognising disability hate crime, conference was reminded of Lee Irving, a young disabled man in Newcastle, who was abused and murdered by a group of ‘friends’ in the city in 2015.

In court, his family, the police and the CPS described it as a disability hate crime, but the judge disagreed, refusing to accept that he had initially been targeted because of his learning disabilities made him particularly vulnerable.

Delegates unanimously backed the call for such hate crimes to be recognised as exactly that.

Similarly, conference also backed a motion calling for ‘mate crime’, where vulnerable people are abused for gain by someone they believe is a friend.

Conference also supported calls for legal recognition of British Sign Language (BSL) and instructed the national disabled members’ committee to raise awareness of the issue, support the campaign for a BSL Act and consider ways in which UNISON can contribute to that campaign.

Key council services need funding, Chancellor told

More than 100 MPs from various parties are backing a UNISON call for more money to tackle the crisis in local government services in Chancellor Philip Hammond’s Budget this afternoon.

They have signed a UNISON open letter to the chancellor calling on him to increase the levels of central government grants to local authorities  and reinvest the surplus generated from business from business rates, giving the money back to local councils to assist with the social care funding gap.

“We would like to stress the urgency of this situation,” says the letter,  “as councils across the country are forced to make difficult decisions to close children’s services, cut housing support, and even struggle to collect council tax on time.”

Widening disability pay gap shows the struggle for equality is far from over

Assistant general secretary Christina McAnea thanked the union’s disabled members for all the work they do when she addressed their conference in Brighton his morning, telling them that it iss vital to keep up the work, since the disability pay gap is now at its highest – 15% – since 2013.

“In-work poverty is very real for too many of our members,” she said. “We know there is a clear link between poverty and disability … living with a disability, what it costs you to live your life, are higher.”

Yet the government remains determined to make savings at whatever cost to people.

Ms McAnea cited the impact of public service cuts on those who provide them, especially disabled workers, and emphasised that, since many workers will find themselves disabled during the course of their working lives, fighting for equality in the workplace is vital for everyone.

In a wide-ranging address, Ms McAnea also told delegates that the union is campaigning for there to be a reciprocal agreement between the EU and the UK after Brexit for some continued form of European Health Insurance Card (EHIC).

In a year of anniversaries – “150 years of the TUC, 100 years since at least some women got the vote, 70 years of the NHS and 25 years of UNISON” – delegates were reminded how the merger that formed UNISON was not “out of necessity but to make a stronger union”.

In spite of the cuts to public services, UNISON has continued to grow and is now the biggest union in the UK, because it is a “tolerant, caring campaigning union”.

“We defied the naysayers” who thought the merger would be a disaster, she told delegates – and urged them to continue their excellent work.

Disabled members speak out over lack of proper disability leave

A busy final morning at UNISON’s disabled members’ conference in Brighton saw delegates work through a wide range of business.

Moving a motion for the South East region, Fran Fox said that it is “recognised that employees with a disability” may need to take time off work “if their mobility or illness becomes severe”.

But it is also recognised that a lack of understanding by some employers about disability leave can result in disabled employees facing “formal action” particularly around absences, though this contravenes the Equality Act.

Kathleen Kennedy for the national committee assured delegates that the union has produced disability leave guidance that can be used to negotiate with employers, but urged conference to “campaign for disability leave to be a statutory requirement written into legislation”.

Determined to let her fellow delegates hear some “good news”, Susan Parkinson from Oxfordshire health branch said that “it is possible” in unionised workplaces to “get things through” – her branch had been able to negotiate disabled passports and disability leave to help disabled workers.

Moving a motion on tackling the disability employment gap, Kevin Buckle for the deaf caucus, informed delegates that, while 80% of non-disabled people have a job, the figure is only 49% for disabled people in general.

But the situation is even more difficult for deaf people: “Some employers even claim that they cannot employ deaf people for health and safety reasons”.

Conference agreed to instruct the committee to consider producing a guide for reps on representing deaf British Sign Language users.

Delegates also:

  • supported a call to make it easier for young disabled workers to access reasonable adjustments;
  • raised the treatment by employers of Black disabled workers;
  • gather information about and publish guidance on neurodiversity;
  • the need to support disabled people to stand for election.

Glasgow equal pay talks resume after successful strike

Equal pay talks have resumed in Glasgow after this week’s successful strike action by UNISON and GMB members in Scotland’s second city.

More than 8,000 union members – overwhelmingly low paid women –  took strike action on Tuesday and Wednesday, with 10,000 marching to a rally outside the city hall on the first day of the strike.

There, UNISON assistant general secretary Christina McAnea told them: “Today, our whole union stands with Glasgow.

“Together, we have taken the fight to the courts and to the streets. Councillors have come and gone, but our demands for equal pay have remained the same.

“The dedication to the cause of UNISON members has been incredible, and it’s been matched by the incredible strength shown by those taking action today.”

The strike followed frustration over the council’s failure to negotiate a settlement to more than 12,000 equal pay claims going back to 2006 and fought all the way to the Scotland’s highest court, the Court of Session, at the turn of the year.

Glasgow City UNISON thanked members for being involved in a “great and historic” two days.

“The strikers were marvellous, picket lines solid and successful, the march and rally incredible and the speeches some of the best ever on a strike day.

“Our two-day strike has resonated with those fighting for equal pay, social justice and equality well beyond Scotland.”

The council and unions met after the strike for a discussion that was described as both “positive” and “constructive”, with talks set to continue.

UNISON Scotland regional organiser welcomed the fact that the council broke its “three weeks of radio silence” to restart negotiations.

“No-one wants a repetition of what has happened this week,” she added. “Tuesday afternoon’s rally in George Square was amazing, emotional and powerful – but we don’t want to repeat it.

“These workers have waited a long time to take such powerful action, but they don’t want to do it again, even though it was an important and historical day. It’s time now for the council to roll up its sleeves and get down to work.”

Delegates voice the need for mental health first aiders

A busy afternoon saw delegates to UNISON disabled members’ conference debate motions covering a wide range of issues.

A group debate in Brighton around the need for mental health first aiders saw Steven Powers from the Northern region first clarify that “a mental health first aider can, with the correct training, listen to your concerns and get you the support that you need” – they would no more be handing out “happy pills” than a conventional first aider would be performing surgery.

Mental health first aider Christine Jackson of Newcastle City branch told delegates that she had used the training “quite a bit” and also been the beneficiary of the others undergoing the same training.

Callum Lam of the East Midlands ambulance service explained that he and his colleagues often experience traumatic situations in their work and mental health first aid could be of help to them, spotting a situation before someone then gets into difficulties by, for instance, taking time off work without permission.

Sharon Dixon from Birmingham shared her experience of a nervous breakdown shortly after a conference, and called for mental health first aiders to be present at such events, as well as in the workplace.

Delegates also discussed how hot-desking impacts negatively impacts on disabled workers.

Since people cannot carry around all the reasonable adjustment equipment that allows them to work, you have to “rock up and hope you can find a desk – and a decent chair”.

And it was also reported that hot-desking can cause particular difficulties for menopausal women. It was recommended that the national committee should publicise “UNISON’s guide, The Menopause and Work”.

MP says we need to change how disability is reported

“People with disabilities are so much more than benefits!” That was how Emma Lewell-Buck MP responded to a question at UNISON’s disabled members’ conference this afternoon, about how much of the media represents disabled people.

The guest speaker – the Labour member for South Shields and shadow education minister responsible for children and families’ policy – said that much of the media coverage of disabled people is, too often, inextricably bound up with reporting about benefits.

That, she continued, was in large part because Parliament makes that link too – that disabled people are only seen in terms of benefits they claim.

“I and my Labour colleagues are determined to move away from the way disabled people are treated,” she said.

Ms Lewell-Buck herself has dyspraxia and mild dyslexia. She was in her late twenties, studying for an MA, when she was diagnosed and she says that it explained why “I couldn’t tie my laces and button my coat” as a child.

Now, “everything I do, I have to plan for – down to the tiniest detail”. But she considers herself fortunate to be in a position where she can raise the subject. Before entering Parliament, she didn’t dare tell her employer, as she was “painfully aware it could affect my career”.

“I’ve embraced my disability – it doesn’t define me, but it’s a part of me,” said Ms Lewell-Buck.

There are “10 million of us [disabled people] in the UK,” she told delegates.

Yet even given such numbers, matters in the UK are regressing, with cuts, fabrication about disabled people and “downright cruelty”.

In the case of work capability assessments, Ms Lewell-Buck had plenty of examples of the way that people were treated by the private company assessors. “How did you catch it?” one assessor asked of someone with Down’s Syndrome.

“For disabled people in the UK,” she said, “the most disabling factor for their daily lives is Tory-led Britain”.

Conference hears how disabled workers face absence problems

A busy morning of debates at UNISON’s disabled members’ conference in Brighton saw delegates tackle a wide range of issues, from the importance of “digital inclusion” – and the difficulties many disabled people face in tackling online application forms – to the need to remember that disabled members may not identify in a binary way, and need to be included by using non-binary language.

The morning’s most moving debate saw Jackie Anderson from Scotland tell the story of Anne, a 43-year-old woman working in the public sector.

She had a disability – endometriosis. It was well managed, but caused short absences from work. However, the employer was unsympathetic and she faced absence procedures.

The union suggested annualising Anne’s hours, but this was refused.

When Anne’s mother was diagnosed with dementia, Anne found herself using annual leave to care. Then her mother died and, just weeks later, her brother too, of an unexpected heart attack.

Anne was given no bereavement leave and the inevitable happened, with her ending up with a formal warning over her hours.

In support, Sharon Dixon told delegates that “how painful this disease [endometriosis] is – it can cripple you and it can spread to your bladder”.

Conference agreed that employers need to be able to apply discretion over attendance processes, and disabled workers in particular should not be pushed into disciplinary procedures so quickly.

Conference passed the motion, which called on the national committee to carry out a number of actions, including publicising UNISON’s own carer’s leave policies.

President hails ‘inspirational’ disabled members

“How on earth can I come to your and be inspirational? Because that’s what you do every day … What you do every single day makes people’s lives better.”

That was the message from UNISON president Gordon McKay this morning, when he addressed the union’s national disabled members’ conference in Brighton.

“I really want to thank you, on behalf of the union, for everything you do.”

Mr McKay went on to speak of how the claims of the Conservative government that austerity is over are “a pile of nonsense”.

Everyone can see this, he told them – apart the government itself.

“This isn’t about stupidity,” he noted, but is “a deliberate choice” not to invest in public services and the working people that need them.

That, the president declared, is why it matters who is in government.

“We have a government where life expectancy has gone into reverse. Austerity is literally taking years off our people’s lives.”

It was “no coincidence” that the poorest local authorities are the ones where funding has been slashed most, yet at the same time, the government’s continued obsession with privatisation continues to cost the taxpayer money – the collapse of Carillion is set to cost taxpayers almost £150 million, while the sell off of privatisation  is endangering abuse victims.

But this union is not just fighting back, but leading the fight, stressed Mr McKay.

He reminded delegates that UNISON “broke the public service pay cap, as we promised to do”; that the union took on and defeated the government over tribunal fees, and that it remains the union fighting for care workers.

Introducing the union’s Grovember campaign to boost recruitment, he said that he was going to “ask you to do just that little bit more.” Every person that is recruited helps to build density and therefore helps to make UNISON stronger.

It was entirely apt that, before Mr McKay spoke, tribute had been paid to “one of the great recruiters,” Irene Stacey, who died earlier this year.

After 25 years, UNISON is now the biggest union in the UK – let’s make it bigger and even stronger, was his message.
